Notice served by AICEIA for Strike on 12th and 13th February'14 following call given by the Confederation of Central Government Employees and Workers


Dear friends,


Notice has been served today i.e., on 27th January, 2014 by the AICEIA for Strike on 12th and 13th of February 2014.

The Confederation of Central Government Employees and Workers has given this  Strike call, and our Association has given notice accordingly, following the Confederation's call.
The Fifteen point Charter of Demands includes several demands crucial to service conditions  particularly of our cadre. While the demands relating to 7th Pay Commission, Interim Relief, DA Merger etc are equally important to us  as to employees of  all Departments,  a demand which is vital to Inspectors of Central Excise is that for an assured number of promotions to all employees. Another very important demand is  for Rescinding the PFRDA Act and to ensure Statutory Pension for all. This is particularly vital to the later entrants to Government Service - we have a very large number of Inspectors who have joined the Department in 2006 and later.


In this regard, our all India Secretary General instructed to all AICEIA Branch and Circle Secretaries are required to immediately serve Notice to respective Chief Commissioners or Commissioners, and start campaigning forthwith for making this  Strike a resounding success.
Remember Comrades, to lose two days' salary is a very small price to pay to demonstrate our solidarity with the Confederation, and to give a wake up call to this Government that we are united and prepared for a massive  struggle to protect our rights. That is the only manner in which we can protect our just interests in this exploitative regime.

Next meeting of the  CEC at Mumbai
As already announced, the next meeting of the Central Executive Committee of the AICEIA shall be held at Mumbai on the 22nd and 23rd of February. Notice for the same has already issued and sent by e-mail to all CEC members and  AICEIA Office Bearers on 17.01.2014. Kindly send in the information required to be sent in by all Circle/Branch/Unit Secretaries  well within the prescribed time limit. The Committees constituted at the Shimla CEC may also finalise their reports and send the same as soon as possible. Meetings prior to the CEC meet may be held by all regional/local fromations of the AICEIA, and resolutions, if any, may be sponsored from the Circles/Branches for consideration by the CEC at its Mumbai meeting.
Those intending to travel by air to attend the meet may immediately book tickets to take advantage of the low fares offered  for bookings made today, tomorrow, and the day-after by some airlines.

Com. Sanjay Srinivasan, Vice President (West)  has informed that  hearing in this case of the Mumbai Bench of CAT   was adjourned yet again - next hearing is scheduled for 29.03.2014.


Progress in Restructuring 

AICEIA is relentlessly pursuing the CR issue with the CBEC at all possible levels. As per the decisions and resolutions of the Conventions and CEC, removal of stagnation and regional disparities in promotions remains our prime concern.
Despite issue of  reminder,  some of the Circles/Branches have not yet sent to the All India Body copies of the Information sent from the CCAs' offices in reply to ADG(HRM)'s letter dated 12th Dec'13 calling for data on Inspectors/POs/Examiners. For want of the same our efforts are somewhat impeded. It is once again requested that the same may please be expedited. Co-operation  in this matter is solicited from all members, who are requested to take up this matter with their Regional Office Bearers for action immediately or e-mail a scanned copy of the infromation directly to the President or SG.

EPF Interest fixed at 8.75 % for the Year 2013-14 – EPFO Central Board of Trustees decides in the meeting today

Retirement fund body EPFO today decided to increase the rate of interest on Provident Fund deposits to 8.75 per cent for 2013-14, a move that will benefit about 5 crore subscribers.

“We have decided to recommend to the government 8.75 per cent rate of interest for 2013-14 to its subscribers,” Labour Minister Oscar Fernandes told reporters after a meeting of the EPFO trustees here.
The Central Board of Trustees, which is the apex decision-making body of the Employees’ Provident Fund Organisation (EPFO), met today and approved the interest rate.
According to sources, the body had surplus funds, which enabled the interest rate to be increased from 8.5 per cent in the previous financial year (2012-13).
The EPFO’s recommendation will be vetted by the Finance Ministry. Once the ministry approves the decision, the interest would be credited to the accounts of subscribers.
According to sources, the decision to enhance the rate was taken in view of the forthcoming Lok Sabha polls.
The EPFO is estimated to have an income of Rs 20,796.96 crore in the current financial year.
Payment of interest at the rate of 8.5 per cent to subscribers would have required Rs 20,740 crore and left a surplus of Rs 56.96 crore, according to earlier projections.

Merger of 50 percent DA may soon be considered by Central Government –Sources

Sources close to the Central Government Employees Federations told that Merger of 50% DA will soon be considered by Central Government before the budget session of Parliament in February 2014. According to the sources, the central government is likely to consider the central government employees  demand for merging of 50 % DA, for the reason that the DA will be crossing 100% level after January 2014.
Merger of 50% DA
The rate of dearness allowance to be paid to govt servants has been increasing consistently due to the rise in the prices of essential commodities for the past two years. In 2011 the rate of DA was at 50 % level. Since then all the Federation demanded the central government to merge the 50 Percent DA with basic Pay. But the government did not accept this demand to merge the DA with basis pay, as it was not recommended by sixth CPC.
The demand would be considered in view of parliament elections
But federations kept on demanding the government that raising dearness allowance alone will not help to compensate the alarming rate of price rice. So they urged the government to consider their demand favorably. It is believed that after the defeat in the election of four state legislative councils, the UPA government has decided to reconsider about its decision on the issues which directly affects the common public. The high command of the ruling party thought that the reason for their defeat in the state election is mainly because of their government failed to contain the price rise. The gap between common public and UPA government has been considerably increased. To correct these failures the UPA government decides to do something to attract the voters.
After announcing the government’s proposal to constitute the 7th pay commission, the community of central government employees has been convinced to have soft view on this government. Further the 50 lakh central government employees would be made happy if the 50% DA is merged with Basic Pay. It is told that , as the central government staff association and federations demanding it very seriously, in case the government decides go with this demand, there will be around one crore voters will be in favour of UPA government. So the government may consider the demand of merging of 50% DA with basic Pay in view of forthcoming Parliament elections.
Allowances will have no impact on merging DA with basic Pay
The sources, associated with National Council JCM, said that the government initially was not willing to consider this demand as some allowance and advances have been raised by 25% whenever the DA crosses 50% level as per the sixth CPC recommendation. But federations insisted that the allowances, which are raised to 25 % level when DA crosses 50%, will have no impact on merging DA with basic pay. The only allowance will have an increase when Basic Pay increases are HRA. No other allowances will be increased and other entitlement of the respective Grade Pay will not be revised as the 50% DA to be merged will be kept under separate component like it was treated in 5CPC as Dearness Pay. “There is no need to worry about financial implications, as the 50% DA will be paid by just changing its nomenclature as Dearness Pay”, said sources.
50% DA merger to be decalered before DA crosses 100%
Further, it has been informed that it is good enough for the government to announce its decision before declaring the next additional installment of DA. Because the AICPIN for Industrial workers for the Month of December 2013 is awaited to determine the rate of dearness allowance to be paid from January 2014.The result of last 11 months AICPIN shows that DA will definitely be raised by 10 % from existing 90% level. So the rate of DA will be 100% with effect from 1st January 2014. After the DA increased to 100%, the demand for 50% DA merger will have to change its avatar. Probably the demand would be for 100% DA merger. So the federations expect the government may consider 50% DA merger soon.
However, decision if any in this regard should be taken before the announcement of election for parliament. It is expected that election announcement for parliament will be made by the end of February 2014. Before that,  the announcement of 50% DA merger is expected from central government.

One Time Permission for availing treatment and investigation for Diabetes, Hypertension and other Cardiac Diseases, Dialysis and Cancer for the period of six months

Sub: Permission for treatment / investigations in respect of CGHS beneficiaries availing treatment for Diabetes, Hypertension & other Cardiac Diseases, Dialysis and Cancer.
The undersigned is directed to refer to the subject mentioned above and to state that at present the CGHS beneficiaries undergoing treatment for Diabetes, Hypertension & other Cardiac Diseases, Dialysis and Cancer require repeated investigations / treatment procedures over a period of time and as per the existing guidelines they are required to procure permission every time to get the prescribed treatment / investigations done at CGHS empanelled hospitals /diagnostic centres.
2. With a view to alleviate the inconvenience to CGHS beneficiaries in obtaining the requisite permission(s) every time, this Ministry has decided to permit issue of permission (referral) letters by competent authorities with a validity of six months from the date of issue of the original prescription for undergoing the prescribed treatment /investigation procedures to be conducted at the prescribed intervals over a period of six months as advised by a Government Specialist. The same permission (referral) letter shall be valid for undergoing the prescribed treatment procedures / investigations on multiple times during the six months, at intervals as advised by the Government Specialist.

                Subject:-   Allocation of posts in Andhra Pradesh-Central Excise and `                                         Customs Formation - Request - Regarding.

At the outset, we the Hyderabad Central Excise Inspectors’ Association would like to submit that we are very fortunate to have our Hon’ble Chief Commissioner as one of the members of the most important   Committee constituted by the DGHRD. We take this opportunity to Congratulate Hon’ble Chief Commissioner for becoming a member of pivotal Committee which will definitely benefit the entire cadre of the department particularly in judicious distribution of sanction of posts in all the cadres.

 At this crucial juncture we take the opportunity to submit the following few lines for consideration while allocating the staff to Andhra Pradesh.

Sir, as on date the cadre of Superintendent is having a sanctioned strength of 711 posts in the Common Cadre of Hyderabad and Vizag Zones. These Zones comprise of 8 Commissionerates with a proportionate strength of 89 Superintendents per Commissionerate. Despite the existing sanctioned strength, it is well aware that there is an additional requirement of the Superintendents to meet the present work load in both the Zones.

However, we may also bring to the kind notice of the Chief Commissioner that the DGHRD vide their letter dated 03.09.2013 has proposed for sanction of 80 posts to each Central Excise /Service Tax/ Customs / Audit Commissionerates.  However, in the said proposals the sanction of Superintendents to Chief Commissioners Office and Commissioner (Appeals) Office was reduced drastically to one post in each office. But the Hon’ble Chief Commissioner is aware that the work load in CCO as well as Commissioner (Appeals) Office indicates the additional requirement.

Subsequently, it appears that the strength of the Superintendents was further reduced to 50 in each Central Excise Commissionerate. This will result in reduction of the cadre in the present Central Excise formations of Hyderabad and Vizag Zones. On examination of the requirement of Superintendents with the work load and collection of revenue we feel that the original proposal of DGHRD @ 80 Superintendents per Commissionerate will make the existing formations to cope up with the existing work load. Besides a separate sanction of Superintendent posts for audit, Service Tax and Customs Commissionerates is required to meet the need of growing potential of revenue in Hyderabad and Visakhapatnam. It may be noted that the Industry particularly the Bulk Drug Industry, Service Tax net, Customs Imports and Exports and the IT industry is having great future in Hyderabad and also in Visakhapatnam. It is to submit that recently a new I.T.I.R has been sanctioned to Hyderabad with 2.19 Lakh Crore Rupees by the Central Government and Government is also concentrating on Second rung cities in Andhra Pradesh for establishing IT industrial hubs. Further bifurcation of state will lead to rapid growth of Service Tax Sector as well as Industry on both sides. Several proposals appear to be in pipeline for sanction by the Central Government to Andhra Pradesh in view of bifurcation. Receding of agitations and on stability of political situation in Andhra Pradesh the potential technocrat strength will show definitely a high growth of revenue as well as requirement of staff in immediate future.

In view of the foregoing we request the benign Chief Commissioner to consider the following points favourably:

i.                      all the Central Excise & Customs Commissionerates to be allocated with at least 80 number of Superintendent Posts each and 90 number of Superintendents in each Audit Commissionerate,
                                                                                                                  
ii.                   the posts allocated to Customs Commissionerate in Visakhapatnam Zone (Kakinada)  may be allotted to Central Excise pool so as to be filled up from Central Excise Inspectors cadre only. This is because all the Minor ports in India are being manned by Central Excise staff only.
